We will investigate whether your trademark name has already been registered with the Canadian Intellectual Property Office(CIPO) by another applicant and whether there is a registered trademark with similar content.
We will submit your application to the Canadian Intellectual Property Office (CIPO) with an application form, your name and address, your trademark, the goods or services associated with the trademark, and the fee.

If everything is in order with your application, the CIPO will assign an application date and application number. Your application will be entered into the Canadian Trademark Database.

Checking registrability A trademark examiner will examine your application to ensure that your trademark is registrable.
If there are any issues with your application, such as confusion with an existing trademark, the examiner will inform us in their report. We provide the service of responding to any of the examiner's inquiries free of charge.

If your application is approved, CIPO sends a formal approval notice to let us know.

If your application is rejected, CIPO will send you a report explaining the reasons why. If your application is rejected, you have the right to appeal to the Federal Court of Canada
If your application is opposed for any reason by a company or individual trademark owner, the Trademark Opposition Board will notify us and you will receive a copy of the statement of opposition. You and the party opposing your application will then have the opportunity to present evidence and written arguments. We will manage the relevant process.
If there are no objections to your application or if the objection is rejected, your application will proceed to registration. The CIPO will send you a certificate of registration and register the trademark in the Trademark Register.
You will need to pay a renewal fee every 10 years to maintain your trademark registration in Canada.
